These Terms of Service (“Terms”) govern your access to and use of aubenacre.com (the “Site”), operated by Eclipsera Fashion LLC (“we,” “us,” “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Eligibility

The Site is intended for users who are at least 16 years old. Products sold on this Site are recommended for ages 16+ as a usage guideline.

Products & Use

We sell makeup/cosmetics (not skincare) through the Site. Product descriptions are provided for informational purposes. Individual results may vary. Please read product instructions and ingredient information (if provided) before use. If irritation occurs, discontinue use and consult a professional.

Orders, Acceptance & Availability

All orders are subject to acceptance and product availability. We reserve the right to refuse, cancel, or limit any order for reasons including, but not limited to, suspected fraud, unauthorized transactions, inventory issues, errors in product or pricing information, or shipping restrictions.

Pricing & Errors

We strive to display accurate prices and product information. However, errors may occur. If we discover an error relating to your order (including pricing, availability, or product description), we may correct the error and/or cancel the order. If payment has already been processed, we will issue a refund to the original payment method.

Payment

We accept payments via PayPal and Venmo.
All transactions are securely processed through PayPal's encrypted gateway. Even if you do not have a PayPal account, you may be able to pay with a debit or credit card via the PayPal Guest Checkout feature, depending on PayPal's availability in your region. We do not store full payment credentials on our servers.

Taxes

Sales tax may apply depending on your location and applicable laws. Any required sales tax will be calculated and displayed at checkout before you complete your purchase.

Shipping

We ship to the contiguous 48 United States and Canadian provinces only, and we do not ship to restricted locations such as Alaska, Hawaii, U.S. territories, Canadian territories, P.O. Boxes, or APO/FPO/DPO addresses. Shipping timeframes, fees, and additional details are described in our Shipping Policy.

Cancellations & Address Changes

Cancellation or address-change requests are accepted only before shipment and are not guaranteed. Once an order has shipped, it cannot be canceled or rerouted by us.

Returns & Refunds

Returns and refunds are governed by our Return & Refund Policy, including hygiene restrictions for cosmetics. No restocking fee is charged for approved returns.

“Delivered” but Not Received

If tracking shows “Delivered” but you did not receive your package, you must contact us within 5 business days of the delivery scan so we can assist with the next steps.

User Content & Communications

If you submit content to us (such as reviews, messages, or photos for support), you represent that you have the right to share it. You grant us a limited license to use such content solely to provide customer support, operate the Site, and comply with legal obligations. We may remove content that is unlawful, abusive, or violates these Terms.

Intellectual Property

All content on the Site (including text, graphics, logos, images, product names, and site design) is owned by or licensed to Eclipsera Fashion LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written permission, except as permitted by law.

You agree not to:

  • Attempt to interfere with the Site’s security, servers, or networks
  • Submit false, misleading, or fraudulent information

The Site and products are provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not guarantee that the Site will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Eclipsera Fashion LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products, including but not limited to lost profits, lost data, or business interruption. In any event, our total liability will not exceed the amount you paid for the product(s) giving rise to the claim.

You agree to indemnify and hold harmless Eclipsera Fashion LLC from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Site.
